Terms and conditions
1. Website operator
The homezzy.pl website, referred to below as the “Website”, is operated by Concept Avenue spółka z ograniczoną odpowiedzialnością, a limited liability company with its registered office in Kraków, ul. Przemiarki 23/72, 30-384 Kraków, Poland, entered in the register of entrepreneurs of the National Court Register under KRS 0000871880, NIP 6762589000, REGON 387620719, referred to below as the “Operator” or “Homezzy”.
Registry court: District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register. Share capital: PLN 5,000.00.

Homezzy provides real estate agency services. Professional liability insurance: PZU, policy no. 1124942706. The terms and scope of cover are set out in the insurance documents; information on the Website does not extend the insurer’s liability.
2. Scope of the Website
The Website is intended for individuals and businesses. It allows users to browse property and service information free of charge, search available listings, ask questions, express interest in selling a property and contact Homezzy. Once launched, it also offers an optional newsletter.
The Website does not provide customer accounts, online payments or the conclusion of sale, rental or agency agreements through its forms. Users do not publish listings themselves. Owners, agents, other agencies and developers provide information to Homezzy, which checks it within the scope of its services and decides whether to publish it on separately agreed terms.
The forms are not intended for uploading documents or photographs. Recruitment and applications to cooperate as an agent or partner are handled by email, rather than through separate Website forms.
These terms apply only to the use of the Website and its electronic services. The scope of agency services, remuneration, exclusivity and the parties’ rights and obligations are established in a separate agreement in the form required by law. Sending a question, leaving a telephone number or submitting a property does not in itself conclude such an agreement or create an obligation to pay commission.
3. Property information
Listings, descriptions, prices, photographs and visualisations are for information and constitute an invitation to make contact and negotiate. They do not constitute an offer within the meaning of Article 66 of the Polish Civil Code, unless an unambiguous statement by an authorised entity provides otherwise. Final terms require separate agreement and an appropriate contract.
The price may be negotiable if accepted by the party authorised to dispose of the property. The Operator does not guarantee acceptance of a proposed price, a reservation, property availability or a particular rate of return. Viewing a listing or sending an enquiry does not reserve the property against other interested parties.
Information may come from owners, other agencies, developers and local partners. Specifications, availability, prices and terms may change. The Operator takes reasonable steps to publish reliable information and correct identified errors, but does not guarantee that every change at source is immediately reflected on the Website. Before making a decision, obtain current confirmation of the terms and documents relevant to the transaction.
Floor plans and areas should be interpreted according to the stated source and measurement method. Visualisations or illustrative materials should be labelled accordingly and may show a proposed arrangement rather than the current condition or furnishings included in the price. Details should be confirmed for the particular property.
Homezzy acts as an agent, not as the owner, seller or landlord of the properties presented. Overseas listings may be handled directly by Homezzy or with a local partner. The identity of the relevant contracting party, scope of service, costs and transaction terms are established before a commitment is made. A general listing description does not replace legal, tax or technical advice or an investment analysis relating to the particular transaction.
The above provisions do not exclude the Operator’s duty of due care, liability for its own acts or omissions, or rights that cannot be excluded by agreement. Receiving information from a third party does not automatically release the Operator from liability under the law.
4. Rules of use and technical requirements
Using the Website requires an internet-enabled device and an up-to-date browser supporting standard website features. Interactive features may require JavaScript, and a response to an enquiry requires a working email address or telephone number. Some external features may depend on separate privacy consent. Access to basic information does not require consent to advertising cookies.
The Operator does not charge for the stated Website services. Users bear internet or telephone connection costs under their agreement with their provider.
Users should provide truthful information, give contact details they are entitled to use and not disclose other people’s data without an appropriate basis. It is prohibited to submit unlawful content, content infringing others’ rights, malware, spam or misleading information, impersonate others, attempt unauthorised access or disrupt the Website.
In the event of misuse, the Operator may take proportionate protective measures, such as limiting traffic causing overload, blocking spam or refusing to handle an unlawful request. This does not limit the right to complain or other statutory rights.
5. Using electronic services
The content-access service begins when a user opens the relevant page and ends when they leave it. Users may stop browsing at any time without charge.
The form service begins when a user uses it to send a message and ends when the message is delivered to the Operator or the user stops completing it before submission. Further correspondence serves to handle the matter raised. Acknowledgement of a message does not confirm property availability or acceptance of an agency instruction.
If technical difficulties arise, Homezzy can be contacted by email or telephone. The Operator may carry out technical work and updates and seeks to minimise resulting disruption. Liability for interruptions and errors is governed by applicable law, rather than being wholly excluded by these terms.
6. Newsletter - once launched
The newsletter contains Homezzy messages about property listings, services and news. Subscription is voluntary and separate from sending an enquiry.
Users subscribe through a form containing clear newsletter information and appropriate consent, then confirm their address through a link in a message. The service starts once subscription is confirmed and continues until the user unsubscribes or the service ends.
You may unsubscribe at any time, free of charge and without giving a reason, using the unsubscribe link in a message or writing to hello@homezzy.pl. Unsubscribing does not affect the handling of a separate enquiry. It does not require an account or a telephone call.
In addition to the right to unsubscribe at any time, where the rules on withdrawal from a distance contract apply to the service, consumers and other persons entitled under those rules may withdraw within 14 days of concluding the contract. It is sufficient to send an unambiguous statement to the Operator’s email or registered office address before the deadline, identifying the service and subscribed address. No form is required; the statutory model provided when subscribing may be used. Starting to send messages does not itself waive statutory rights. The service is free and withdrawal carries no charge.
The Operator may end the service because it permanently discontinues it, a change in the law prevents its continuation, or documented misuse occurs. If this affects the whole mailing list, advance notice will be given unless the law or security requires immediate action.
7. Rights to materials
Rights to protected Website content, particularly original descriptions, photographs, graphics, videos, designs and branding, belong to the Operator or the relevant rights holders who supplied the materials. Making material available on the Website does not grant an unlimited licence or transfer rights.
Without the rights holder’s consent, protected materials may not be copied, distributed or used in other listings, advertising or commercial activities unless permitted by law. This does not limit permitted use, statutory exceptions or sharing an ordinary link to a lawfully available page.
Without appropriate authorisation, users may not extract or reuse the protected listings database or a substantial part of it, or systematically bypass access safeguards. The scope of protection depends on the conditions under copyright and database protection law.
In the event of infringement, the rights holder may pursue remedies provided by law, including cessation of infringement, removal of its effects and compensation where the relevant conditions are met. These terms do not impose an automatic monetary penalty for merely copying content.
8. Errors, infringements and complaints
An error in a listing, infringement of rights to materials or other suspected unlawful content may be reported to hello@homezzy.pl. Please include the page address or listing reference, a description and reasons for the report, and contact details for a response. Reports are reviewed; where justified, content will be corrected, restricted or removed. A report alone does not establish that an infringement or claim is valid.
Complaints about Website services may be sent to the same email address or in writing to the registered office. Describe the problem and the desired resolution and provide contact details for a response. A missing attachment or use of a different format from that suggested does not automatically result in rejection. If additional information is needed, the Operator will request it; this does not in itself suspend the statutory response deadline.
The Operator responds to complaints within 14 calendar days of receipt, on paper or another durable medium such as email. Where Article 7a of the Polish Consumer Rights Act applies, failure to respond within the statutory period has the effects specified in that provision, including acceptance of the complaint. Rights under specific legislation remain unaffected.
Complaints concerning the performance of a separate agency agreement are considered under that agreement and applicable law. These Website terms do not restrict rights connected with such an agreement.
9. Personal data and external services
The rules for processing data are set out in the Privacy policy, and the rules for tracking technologies in Cookies. Reading the policy does not constitute marketing consent.
Links to other websites and messaging services may lead to services of other entities operating under their own terms and privacy policies. The Operator’s liability for selecting, presenting or operating its own integrations is governed by law and is not excluded merely by referring to another party’s rules.
10. Final provisions
These terms are provided free of charge and should be available to save and print before using the services. On request, the Operator will send them by email.
Changes may result from changes in law, the scope of services or significant technical requirements. A new version includes its effective date. For an ongoing newsletter subscription, users receive notice of a material change on a durable medium at least 14 days in advance and the opportunity to unsubscribe. Changes are not retroactive and do not affect acquired rights; separate consent is required where prescribed by law.
Use of the Website is governed by Polish law, without depriving consumers of protection afforded by mandatory provisions applicable to their circumstances. Court jurisdiction is determined by law; we do not impose the court at the Operator’s registered office on consumers. Consumers may seek assistance from a consumer ombudsman and use available out-of-court procedures under applicable law. These terms do not restrict the right to bring a matter before a court.
These terms apply to use of the Website from the time they are made available on it, subject to the rules above concerning ongoing services and changes.
